Before proceeding, please read these Terms and Conditions (hereinafter referred to as these “Terms”) carefully since these Terms shall govern the relationship, we, at Jesus Gear, shall have with you.

We, at Jesus Gear, offer a wide variety of shirts, bags, accessories and much more (the “Goods”) through our website, jesus-gear.com, (the “Website”). The Goods which are offered are all created, developed, manufactured, sourced and designed by us and our affiliates. The Website is easy to use, browse and has been carefully curated in order for you, the customer, to find what you are looking for.

3. The Website

The Goods which are offered on the Website are displayed on as “as is” basis. Please be careful when it comes to selecting the size, color and other details and ensure that you have selected the appropriate product. In case there appears to be a problem, please read the “Refund Policy” available on the Website.

The Website is our sole and exclusive proprietary property and we retain the complete right to change, alter, modify and/or delete any of the products available on the Website or any of the terms herein. You are requested to keep visiting these Terms in order to remain apprised of any changes herein.

You are requested not to use any automatic device, program, manual process or algorithm to access, copy or imitate the Website. In addition to not copying or imitating the design, look and structure of the Website, the links, the material provided herein. You shall not use any software, hardware, device, method, algorithm which disrupts, interferes or creates a disturbance within the Website. You are required not to use the Website for any activity which is illegal, or are known to be illegal or for any other purpose which is unlawful.

All marks, designs, graphic designs, logos, texts, photographs, artwork appearing on the Website (collectively the “Works”) are our sole intellectual and proprietary property. We ensure that the Goods available on the Website are our own.

4. Our responsibilities and obligations to you

We are grateful you have opted to choose the Website and are desirous of purchasing our goods. In this regard, please note the following obligations we have towards you:

• We shall ensure that the Goods are fit for purpose and use;
• All deliveries and shipments will be made on time and in case of any delays, we request an email from you and we will reply within 24 hours;
• All data provided to us by you will remain protected and shall not be disseminated to any third party whatsoever. In this regard, please read our Privacy Policy which is available on the Website; and
• Our customer care service will be responsible for ensuring that in case you are not happy with the product you have received, and have a valid reason under our Refund Policy, we shall ensure that your problem is resolved forthwith.

5. Your responsibilities and obligations to Jesus Gear

By virtue of using the Website, and purchasing the Goods, please note that these Terms shall be applicable to you along with all other policies available on the Website.

Please ensure that whilst selecting the goods, you are careful in choosing the correct product. We may not be able to facilitate or exchange the product in case the stock finishes.

At the time of checkout, you may be required to provide us with certain details such as: name, address, e-mail address, phone number, city and country. Please ensure that all data is correct, honest and truthful. Furthermore, the address provided by you will be the address to which delivery will be taken place, therefore, it is your responsibility to insert precise information. In the event any information provided by you is incomplete or incorrect, we cannot be held responsible for any consequences arising therefrom.

In the event of incomplete delivery address, please note that the goods you have selected will be returned to us. We may contact you in order to receive the complete details, and thereafter, we may re-send the goods to you for an additional shipping fee, else, we will place a hold on your shipment. Please contact us within 3-5 working days from expected delivery in the event you did not receive the goods you had ordered.

You may be required to create an account with us. In this regard, you may need to create a specific and special username and password in order to access the Website. It will be your sole responsibility to ensure the confidentiality of the username and password you select. In case you forget the aforesaid, we may be able to facilitate you in such event upon you contacting us. You agree to notify us immediately in the event you suspect any unauthorized use of your account, or any other breach of security.

6. Payment

Once you have carefully selected the Goods you are desirous of purchasing and you have been redirected to the check out page, you will be required to provide us with information in relation to the payment.

Please note that you will also be required to pay a shipment fee. The shipment fee shall be of two kinds, i.e.,: (i) standard; or (ii) express. The standard shipment fee means the goods you have purchased shall be delivered in 7-10 business days. The express shipment fee means that the goods which you have purchased shall be delivered in 5-7 business days. In case of any holds for reasons which are outside our control, please note that we shall inform you immediately via e-mail.

Payment may be made by either: (i) PayPal; (ii) Credit Card; (iii) Google Pay; (iv) Apple Pay; or (v) Venmo. Please note that 2 or more options are available and at the time of checking out, you may choose either of the options. The information required by you is required to be true, correct and valid. Please note that in case you choose to make the payment via credit card, you are required to ensure that the card which you have chosen is compatible and also valid.

Once payment has been affected, your order will be marked as processing and will be further processed by us.

7. Privacy Policy

Our privacy policy, available on the Website, is to be read part and parcel with these Terms. Additionally, by using this Website, you hereby acknowledge and agree that you have read and understood the Privacy Policy.

8. Disclaimer

For purchases via the Website, by clicking on the “Accept” button you agree to these Terms which will bind you. If you do not agree to these Terms you must cease to continue to purchase any Services from us.

The information provided on this Website is for general information purposes only and in order for you to purchase our products. We endeavor to keep the information up-to-date and correct, however, we make no representations or warranties of any kind, express or implied, about the completeness, accuracy, reliability, suitability or availability with respect to the Website or the information, products, services, or related graphics contained on the Website for any purpose. We shall not be liable for any direct, indirect, incidental or punitive damages including loss of profits, business or monies, even if we are notified of such anticipated damages.

You hereby agree to indemnify and hold and defend us, our representatives, managers, partners, and all personnel from any and all litigation, costs, expenses, losses, liabilities, claims and expenses (including attorneys fees) made against us by virtue of use of the Website.

11. Governing Law

These Terms shall be governed by and construed in accordance with the Federal Arbitration Act, applicable federal law, and the laws of the state of Florida, without regard to principles of conflict of laws, and any dispute of any sort that may arise between you and Jesus Gear.

12. Miscellaneous

You understand that if you are found in breach of these Terms, we reserve the sole discretion to terminate or otherwise restrict your access to the Website.

If any of the provisions of the Terms is held as illegal or void by any competent court with rightful jurisdiction, that specific provision shall be deemed to have been removed. All other terms shall continue to exist in full force and effect.
